Ticket Fixing. Procedure.

As the folks of 702 know, my firm (Neeman & Mills, Ltd.) will happily handle your traffic citations for most local courts, free of any charge for our services. In order to handle this, I need a procedure to be followed.

1. I'll represent you in attorney session traffic court, for NO attorney's fee at the following courts:

- Las Vegas Justice Court;
- Las Vegas Municipal Court;
- Henderson Justice Court;
- Henderson Municipal Court;
- North Las Vegas Municipal Court
(Note, I won't appear before North Las Vegas Justice Court for reasons stated in the second post in this thread)
- Goodsprings Justice Court;
- Searchlight Justice Court.


2. I'll handle your ticket for no charge if it is not in warrant already (i.e. you have brought me the ticket two weeks before the hearing date; and please see #4 below). If you want me to handle it after the hearing date on your citation, I will have to file a motion to quash your warrant and will charge a $75.00 fee for that. Also, keep in mind the more "serious" charges like Reckless/DUI/Aggressive Driving/Evading require me to go to the regular criminal docket and cannot typically be adjudicated in a quick "attorney session"; accordingly for those type of charges, I can't do those for free. But the run of the mill speeding tickets etc, I can do free of charge.

3. Bring the ticket to my office (1201 S. Maryland Pkwy, LV, NV 89104, M-F 9am-5pm). Faxing the ticket won't usually work, the image is often degraded after faxing. Don't mail them either. Don't email them. I don't want your ticket to get lagged in the mail, or get lost in the mail and cause your case to go to warrant. Just drop it off at my office. Heck, if I can go to court for you for free, you can swing by my office and drop it off.

4. THIS IS IMPORTANT. Please be sure to bring your ticket into my office NO LATER THAN TWO WEEKS BEFORE YOUR SCHEDULED COURT DATE. If you do not, I will charge you $50.00. Why do I do this? Simple. I set my traffic tickets once a week. And because of the limit of tickets that can be heard at a single traffic court adjudication (in Justice Court) I need this much time in order to schedule all the incoming tickets.

5. Tell my receptionist your are a 702sportbike member, and make sure you give her your current contact info: this includes your name, a current mailing address and current phone number. Also give her your 702 screen name.

6. Also give to my receptionist anything needed to supplement your citations (i.e. often copies of driver's license, vehicle registration, documents from the DMV, proof of insurance, proof of residency, etc are needed in order to fight portions of your ticket). It is incumbent on you, and is your sole responsibility (not mine or my staff) to provide my office the correct documentation so I may fight your charge. Neither I, nor my staff reviews the "correctness" of the documentation you provide. On the day of court, I merely present what you provided to the judge and he and I discuss it and the impact on your case. If you provided me the wrong or improper documentation, the judge will rule accordingly and we won’t get another opportunity to present the correct documentation in the future. Also, the judge is the arbiter of what is sufficient evidence. Once I go to court on your behalf, bringing me the correct support documentation AFTER I have gone to the judge will not help your case. Once the charge is adjudicated, the case is over. So, if there is any documentation you want the judge to see, drop it off at the same time as you drop off your ticket.

7. If you bring me the ticket two weeks BEFORE your hearing date, I can set the ticket for an attorney session (again, please see #4 above). Setting a ticket for attorney session may cause your court date to be reset; often many weeks (sometimes months depending on the court docket schedule) beyond your original court date shown on the citation. Additionally, some courts make the fines higher so that the person can totally avoid traffic school. Unless you inform me in writing at the time you drop off the ticket to the contrary, I will always select the route that doesn't involve traffic school when handling tickets; even if it means a higher fine.

8. No need to PM me (or call my cell phone) to ask me status. If you followed the above procedure you will get a letter from my firm telling you the disposition of the citation after I have attended court on your behalf. Again, the court system in southern Nevada is often busy and quite booked up. It often (but not always) takes weeks and often months to get a ticket adjudicated before some of the courts. In that letter you will be informed the outcome and what you owe the authorities and what your case/fine was reduced to. YOU MUST FOLLOW THOSE INSTRUCTIONS my office sends in the letter. Failure to do so, will result in your case falling into warrant.

9. Please don't call my personal cell phone to discuss tickets and other non-emergency matters. Use my personal cell phone to talk about bikes, bike events, life in general, and if you need legal help for an accident or injury case.

10. Failure to follow any/all of these steps may very likely cause your ticket to fall into warrant. And I don't go to court a second time for free for tickets that fall into warrant for failure of folks to follow all of the above- steps.

11. Keep in mind every court is different. Some hit with much heavier fines than others. Some do not offer deals as "good" as other courts. I have noticed with the slowing economy these last few months, some courts are actually becoming MORE difficult to deal with (i.e. I'm seeing higher fines, and more violations NOT being reduced to parking violations). Some courts won't reduce every citation to a parking ticket. There is no guarantee of any particular outcome. That's just the way it is, I don't control the prosecuting attorneys or the judges; I just go in and plead your case so you don't have too. That is, I save you time and effort at my expense (i.e. my time and effort) and I do it free of charge. Please remember that.

12. In return for handling your ticket for no attorney's fee, all I ask is that you remember my firm in the future. If you, a member of your family, your friends or your co-workers are in an auto, moto, aero, boating, firearm, animal or work/industrial accident/injury as well as tragic wrongful death claims, let me know and my firm can very likely help you get compensated for your loss and your injuries.

*Update*. No longer making appearances in North Las Vegas Justice Court. They don't give an attorney session with any benefit to the client. So, just attend yourself and you will get the same deal as if an attorney appeared with you in this court. (Note I still attend North Las Vegas Municipal Court.)

*Update* I have added two courts to the list of tickets I can take care of; namely Goodsprings Justice Court and Searchlight Justice Court. Both allow me to do "fax adjudication" without appearance. Now, they aren't likely to cut good deals like the bigger greater Las Vegas valley courts are... but at least you won't have to drive out there and wait in a line.

*UPDATE*

Bad news folks.

New Chief Judge for Justice Court. Shortly, ALL deals in Justice Court will end. Fines are going to triple to quintuple. Fines are going to become HUGE. And, for ALL moving violations they are going to REQUIRE traffic school. The sitting judge informed us today. He said, and I quote "You attorneys will no longer get better deals than the general public... you will get the exact same deal as any regular joe walking in from the street."

Sorry for the bad news.

*Update* April 20, 2009

As of JULY 1, 2009 the fines in Las Vegas Justice Court are going up. They have not released the amounts yet. Also, the word at the Las Vegas Justice Court is still indicating mandatory traffic school for cases adjudicated after this date, however that is not yet confirmed. They also have not yet confirmed if this effects all county justice courts, or just Las Vegas Justice Court. As I find out the information, I will pass it on to you.

Finally, I don't control the court docket, the court does, so please don't ask if I can get your ticket set before the July 1, 2009 date.

Good news.

Justice Court fines have been updated. While they are a bit higher, they nothing that we were being warned of earlier this year. Justice Court appears to continue to work with the attorneys during attoney session and so far, we're not seeing mandatory traffic school for most minor traffic violations.

I've noticed a trend at Henderson Municipal Court of late. Namely, that they are requiring, on a much more regular basis, that traffic offenders attend traffic school.

Fines aren't quite as bad as they were blustering about last summer. While they have gone up, they did not double and triple like we feared.

However, a significant change did happen at Justice Court. That is, I can only appear with 15 or less tickets at once. And it was not uncommon for me to have more than that in a given week. Therefore, I had to make a change. Namely, I now need your tickets at least two weeks before their scheduled hearing/appearance date (it's printed on the citation you were issued). Please make sure you get them to me within that time frame. If you don't, I have to juggle my schedule (which is a PITA for me) and as a reminder to you not to do that, charge you $50 (which is a PITA for you). So please, just bring the tickets in with at least two weeks to spare before your hearing date, and I'll gladly handle them free of charge as always.

Well, I've learned some disturbing news. In these trying economic times, it appears that our lovely government is dispatching the Deputy Constables to go to people's homes/apartments and attempt to collect your outstanding traffic ticket warrants. That's right, front door service. And they offer you a wonderful deal too. Pay ON THE SPOT or GO TO JAIL. Choice is yours. Nice, huh? Anyway, even if your ticket is only a few days or weeks into warrant status, and that ticket is just a small traffic violation (no accident or hit and run or DUI or reckless necessary; run-of-the-mill traffic violation that has fallen into warrant is all that is required to get one of these delightful visits) be advised they are sending armed governmental collection agents to your front door with a badge, a gun, a warrant, police powers, and a credit card processor.
